Terms and Conditions of Booking

These terms govern the booking of activities through canaryacht.com. By completing a booking you confirm that you have read and accept them.
1. Who you contract with

The activities are provided directly by this company, with its own boats and its own staff. This website does not act as an intermediary for third parties.
2. What you book and at what price
Each activity is described on its own page: what it consists of, how long it lasts and what it includes. The price charged is the one calculated by our server using the rates in force at the time of booking, and it is the price shown before you confirm and in the confirmation email.
Prices are expressed in euros and include the applicable taxes (in the Canary Islands, IGIC — the Canary Islands General Indirect Tax — rather than VAT).
Activities without a published price
Some activities have no published price. For these, the form requests a quote and does not book anything: nothing is charged, no place is taken and there is no contract until you accept the quote we send you.
3. How to book
You choose the day, the time and the number of participants, give your contact details and confirm. While you complete the process, the places are set aside for a limited time; if you do not finish within that time, they go back on sale and you have to start again.
The booking is formalised when we confirm it to you by email, with its reference. Keep that email: it is your proof of booking.
4. Payment methods
Bookings made on this website are paid in cash at the marina, on the day of the activity, directly to the crew. No payment is taken online and no card details are requested.
Your place is booked as soon as you receive the confirmation email, even though nothing has been paid yet. That email says so in those words — “you will pay” — and does not state that you have paid.
5. Cancellation by us: the sea decides
These activities depend on the state of the sea. We may cancel a departure because of swell, wind, calima (dust haze) or any other safety circumstance, and that decision is taken by the skipper of the boat.
If we cancel, we will let you know using the contact details you gave us and offer you a new date or cancel the booking at no cost to you. As payment is made on the day, at the marina, nothing will have been charged.
6. Cancellation by you, and the right of withdrawal
If you cannot come, let us know as soon as possible by phone, WhatsApp or email. The sooner we know, the more likely it is that we can resell your place.
Important and mandatory notice: leisure services with a specific date or period of performance — and a boat trip is one — are excluded from the right of withdrawal under art. 103 l) of the Spanish consumer protection act (TRLGDCU). In other words, there is no fourteen-day period in which to withdraw without giving a reason. What does apply is whatever has been agreed with you.
7. Punctuality and boarding conditions
Please arrive at the meeting point (Marina of Puerto de Mogán, 35139 Lomo Quiebre, Las Palmas, Spain) as far in advance as you are told. If you arrive late and the boat has already left, the trip cannot be recovered.
For safety reasons we may refuse boarding to anyone who turns up under the influence of alcohol or other substances, or who does not follow the crew’s instructions. On board, the skipper’s instructions must be followed.
Minors travel under the responsibility of the adult accompanying them, who must go with them.

These terms are governed by Spanish law. If you are a consumer, you may bring proceedings before the courts of your own domicile.
